IP Litigation in India has seen various trends over the course of years. It is only in the last 10 years that patent litigation has grown considerably and has led many Indian firms to enforce or oppose patents. A growing economy, increased awareness about patents and its commercial exploitation in formulating competitive Strategy has led to number of patent disputes landing in courts, playing a very important role in ultimately resolving the disputes and interpreting the law.
It is therefore essential for companies; to not only to obtain IPR Rights; but also be vigil, evolve their existing strategies to prevent dispute, invalidation and/or infringement.
The Need:
IP Litigation may be a lengthy process and cost incurring practice, but it retains the right of an owner and serves as a factor for enforcement of IP. Several strategic plans can be adopted by promoting the utilization of alternative dispute resolution (ADR) mechanisms, arbitration procedures, and other preventive measures to avoid opportunistic litigation costs, so that IP enforcement and litigation do not create bottlenecks.
IP Laws and the practices are taking its revolution in India, which is evident with the number of cases filed; and is constantly expanding in spite of several challenges, which paves way for technology and Innovation to evolve for the growth of the Country. Hence, one has to be updated & follow a right strategy during the enforcement and apply timely decisions.
With this background, CII is organizing 4th edition of our annual event Conference on IP Litigation: LITCON 2018 at Hotel Westin, Hyderabad to provide an ideal forum to discuss on evolving dynamics in the area of IP Litigation in view of recent case laws as well as harmonization of laws viz. Biodiversity Law, Customs Law, Tax law with IP Law and its impact on ease of Doing Business.
Objective:
The main objective of LITCON 2018 is to provide a platform to discuss on evolving strategies that would help participants in managing IPR litigation costs and mechanisms to minimize the effects of any such litigation.
