What is section 498 A?
Passed in 1983,section 498A of the IPC in its current form reads as - “Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. The offence is cognizable, non-compoundable and non-bailable."

 

Facts:

 

The rampant usage of the draconian law 498 A, cases against men are gaining traction. 92% of the people who have been arrested under IPC section 498A were found not guilty, pre and post trial. 1.7 million people have been arrested under IPC 498A in last 12 years.

 

NGOs like Save Indian Family Foundation and My Nation Foundation conducted pilot studies to find shocking findings. One of them was an online study in which it was revealed that 98% of the husbands have faced domestic violence at some point in time in their life at the hands of their wives and in-laws in the form of physical abuse, verbal abuse, mental abuse, emotional abuse, financial abuse, etc.
